Ixyst Corporation is the owner and operator of photoApe.com.

Ixyst Corporation has a number of rules that every person subscribed is required to abide. As an Ixyst Corporation user, you are required to check the Terms of Service checkbox on the registration screen. By doing so, you agree to the rules listed in this Terms of Service Agreement. Violation of any of these rules may lead to termination of your account and service with Ixyst Corporation. Ixyst Corporation also reserves the right to modify any user data or cancel any user account without prior notice and/or specific reasons.

Agreement Modification
Ixyst Corporation reserves the right to modify any part of this agreement at any time. It is the user's sole responsibility to keep updated with the content of the Terms of Service Agreement. Any change will be effective immediately and will not be announced in any way.

Terms of Use
Ixyst Corporation's photoApe.com is an online photo sharing service. Users can upload personal photos organizing them in albums and applying various access types to each album or individual photo. Whereas photoApe.com offers a very high level of security, Ixyst Corporation does not guarantee prevention of unauthorized access or loss of data. Users are advised to keep a copy of their photos separately from photoApe.com and not rely on Ixyst Corporation for secure data storage or secure access. Users should not upload photos of high personal or material value.

Prohibited Use
Users are prohibited to use photoApe.com (1) in any manner that violates any law, regulation, treaty or tariff or infringes on the legal rights of any third party, (2) in any manner which is defamatory, fraudulent, indecent, offensive or deceptive, (3) to threaten, harass, abuse or intimidate others, (4) to break security on any computer network, or to access an account that does not belong to you, and (5) in any manner that interferes with other customers' use of photoApe.com.

Prohibited Content
Users are prohibited from storing, posting, distributing or transmitting any unlawful content at photoApe.com. Pornographic materials are also strictly prohibited.

LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL IXYST CORPORATION OR ITS OWNER(S) AND DEVELOPER(S) BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT ARISING OUT OF YOUR USE OR INABILITY TO USE PHOTOAPE.COM, ANY OF IXYST CORPORATION'S CONTENT, SERVICES, PRODUCTS AND/OR ANY RELATED SOFTWARE. IN NO EVENT SHALL IXYST CORPORATION'S AND ITS OWNER(S) AND DEVELOPER(S) TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE IXYST CORPORATION WEB SITE.

Copyright and Trademark
It is the obligation of the individual members to ensure that the posting of their photos is not violating any copyright. Members are solely responsible for the content of their photo albums.
